The 1960 agreement
The Indus Waters Treaty was signed in Karachi on 19 September 1960 by India, Pakistan and the International Bank for Reconstruction and Development. The United Nations treaty record states that it entered into force on 12 January 1961, with retroactive effect from 1 April 1960. The agreement followed years of negotiation over a river and irrigation system divided by the 1947 partition. Its impact cannot be understood by looking at a border alone: rivers, canals and headworks connect communities and agricultural land across a much larger basin. The treaty text contains detailed provisions and annexes.[1]
Eastern and western rivers
A World Bank legal study explains that the treaty grouped the Ravi, Beas and Sutlej as eastern rivers and the Indus, Jhelum and Chenab as western rivers. It describes allocation of the eastern rivers to India and the western rivers to Pakistan, while noting that each party was allowed specified uses of rivers allocated to the other. It also describes the creation of a Permanent Indus Commission. This summary is a starting point rather than a substitute for the treaty’s detailed qualifications, transition arrangements and dispute procedures. Punjab’s irrigation systems make these arrangements especially relevant to the region.[2]
A continuing dispute
The treaty’s current status is contested. An arbitration court’s March 2026 procedural order records India’s April 2025 decision to hold the treaty in abeyance and Pakistan’s request for a determination of its status. On 31 August 2026 the court found that the treaty remained in force. India rejected the tribunal’s authority and said its abeyance decision remained in effect, according to reporting of its foreign ministry’s position. These are distinct positions, not a consensus on their legal effect. The historical allocation above is not an assessment of present compliance or water flows; consult current proceedings for later developments.[3][5][6][4]
